Hey, anybody out there with a NY state C&R license having this problem. I got my c&r about a year ago and have been loving it. Picked up a rifle and several handguns. One handgun I disposed of through gunbroker.com to a buyer in Texas. Problem is I'm also a local cop and when I submitted the paperwork to my dept range people I was told that I couldnt dispose of a gun directly to Texas without going thru a NY state dealer. I explained that I have a c&r but was told that NY doesnt recognize c&r firearms, they said that if you can buy ammo for it and it shoots it's a gun period. I was given the whole spiel about state law superseding federal law etc. The best part is that I initially got a visit from the ATF to my house as part of the application process(not unusual in NYC area) and the agent told me about state law superseding federal law but all she said was dont order any assualt rifles, nothing about pistols. I've seen posts about California Licesne holders having problems with handguns bt never NY. Now they want me to get the gun back from Texas and have a NY state dealer send it back to Texas or have a NY dealer add it to his books as being shipped to Texas. Both situations highly unlikely and probably illegal for the second one. Any body else have this problem or anybody have any suggestions for a solution???? Need help in NY !!!!! |
