I have moved from Pennsylvania back home to Tennessee, I was trying to change my C&R to my new address in Tennessee, but the local sheriff is saying that I have to come down to them IN PERSON, show them my driver's license and pay them $10 for a background check or they "won't approve" my amendment to my C&R. Is this normal? I didn't have to do any such thing in PA. Doesn't the ATF do a background check that is probably far greater than what the local sheriff can do? What is the point of this, or is it just a money grab that I'm gonna have to do just to keep the locals off my back? |

I gather that you notified ATF of yr address change, & the ATF notified yr local sheriff. I cannot speak for C&R matters, but if an FFL holder moves to a new jurisdiction, he will have to comply with the laws of his new state/local gov't in order to keep his FFL. You might want to research the Tennessee state laws on firearms ownership as well as any pertinent county regulations where you reside. The state law might well be available on the Internet--do a search in yr state gov't & I'll bet you'll find the state code. Or a local library should have copies of the Tennessee laws. Don't know if the time involved is worth the ten bucks, but I hope this helps. |

While JW makes a valid point about local laws, this is the basis of the letter that I delivered to the CLEO when I moved from a rual enviroment into the city: "Per the requirements stated in section 2, line 4 of form "ATF F 5300.38", "APPLICATION FOR AMENDED LICENSE (COLLECTOR OF CURIOS AND RELICS)", I am delivering a copy of this completed form for your records. Should you or your representative wish to discuss any item on this form, please feel free to contact me......." I did pretty much the same when I renewed and in neither case did I ever get a call or visit from them. Tom http://www.yrpc.org |

Well, I'm from TN so I'm pretty familiar with the laws here. Not a big deal, just never had a C&R before. I got it while I was away. I went and had it done, and they didn't even charge me anyway....so I got my stuff done, and my bound book now, so I'm off to a gun show Saturday to go shopping. lol |

And we know the CLEO doesn't have to "approve" anything just be notified. BTW I still believe in most States the CLEO is the Sheriff not the Chief. The Sheriff has jurisdiction thru out the county-including inside the city limits. |
